You may all believe that the compensation payments are unjustified but they are not.With regard to Paicolex Trust Management AGThe trust company and its trust officers must make independent decisions as to payments out of the trust. The trust officers were clearly not independent and have therefore breached their fiduciary and legal duties to both the trust itself and to the beneficiaries.This grave misconduct has resulted in one of the beneficiaries (i.e. me) being not only financially disadvantaged but has caused me significant emotional and physical harm and has been the primary cause of my psoriasis, a very painful affliction, cause by huge amounts of stress.The trust officers have been well aware for a number of years of the brain cancer removal operation that has subsequently caused a very high susceptibility to stress and have thus put myself in significant personal physical danger. It is no exaggeration to say that I could have had a fatal heart attack at any time.With regard to Berwin Leighton PaisnerAs the holding company of the above, Berwin Leighton Paisner is to be held ultimately responsible for Paicolex’s actions and the grave effects that were caused to myself. Not only that, but BLP has been made aware countless times of all situations pertaining to me and they, including the Managing Partner, Lisa Mayhew, completely ignored my concerns and took no action whatsoever to protect me. They have, by their own admission, failed to bring to task those responsible for behaving in this way towards me and are thus just as culpable as Paicolex, as if Berwin Leighton Paisner had made those unfair and dishonest decisions and acted in a prejudicial way towards me and have thus breached their own fiduciary and legal duty of care that should have been afforded to me.
With regards to William Thomas Hender, my fatherHe has acted in a manner that has been highly prejudicial to me and has behaved outside his duties and responsibilities to the trust. By his actions, in demanding that the trust officers effect certain transactions that have caused me much distress and emotional harm, he too is culpable for his actions and must pay compensation as a result.With regards to Paicolex Trust Management AG, Berwin Leighton Paisner and William Thomas HenderAll of the above parties have acted in concert in attempting to financially ruin me and to cause me harm, a level of harm that cannot, by any account, be monetised but a figure there has to be. No amount of money can assuage the level of harm that has been caused to me by the parties conspiring against me and by agreeing that spurious amounts of debt are due, by deducting sums, without my consent (which goes against every rule in the book as to legal and fiduciary duties of care) and for all acting in such an unprofessional way as to an outsider believing that the trust and its assets are to do with as they please.I cannot force the termination of employment of those individuals who directly acted in a way that was against my interest but removal of those employees, it has to be.By the continual failure to hold those responsible to account, including Lisa Mayhew,the Managing Partner of Berwin Leighton Paisner, all of the entities have continually failed in their fundamental duty of care to the law and have failed in their legal and fiduciary duty of care to me, as a beneficiary.In any firm that is professionally run, those people involved would have all be sacked for gross misconduct or removed from office for the same offence and walked out of the door by security, with no compensation for loss of office being paid but Berwin Leighton Paisner and Paicolex Trust Management AG have failed in even that fundamental basic responsibility.It is quite clear, by their own inaction and actions, that neither Berwin Leighton Paisner or Paicolex Trust Management AG can ever be trusted to either abide by the law or to protect the beneficiaries of a trust from harm but would rather throw away their independence and take instructions as to how the trust should be handled by a third party or associates of that third party.I cannot take Paicolex to court as its is outside the jurisdiction of UK law but by suing Berwin Leighton Paisner, it would be a case of Goliath, with its massive funds, against a David, who has few funds but has been subjected to continual and conspiratorial harm by all parties.Regards
